Employment Law Update 2015

We are pleased to publish our latest Employment Law Update which provides you with guidance on some of the key areas of change within employment law that has come into force over the last 12 months.

In this update we have covered Acas Early Conciliation, Holiday pay and the new Shared Parental Leave Regulations.

Whilst ACAS Early Conciliation is more of a new procedural point for Claimant’s, as the employer and Respondent to any potential proceedings, you will be contacted with a view to conciliating in an attempt to avoid litigation. It is therefore useful for you to be aware of the process and most importantly how conciliation effects the time limits that Claimants have to issue claims against you.

ACAS Early Conciliation

Our update in respect of Holiday Pay and how it should now be calculated comes from the landmark case of Bear Scotland Ltd-v-Fulton & Others and is of particular importance where workers receive commission and/or regularly work overtime.

Bear Scotland Ltd –v-Fulton (and others conjoined) – Holiday Pay

The Shared Parental Leave Regulations will apply to workers whose expected week of childbirth/adoptive placement begins on or after the 5th April 2015. The guidance notes provided will provide you with an overview of the rights that workers will have and will assist you in altering or adding to your current family policies and procedures.

If you would like any assistance in connection with the topics covered in the update or indeed any other aspect of employment law, please do not hesitate to contact a member of the Employment Team.
