Ian Barnes

Ian joined Allington Hughes in 2007 having graduated from the University of Wales, Aberystwyth with a Law degree. He then went on to study at the College of Law in Chester.

Ian works in our Criminal department and provides advice and assistance at the police station and the Magistrates Courts, he is also a Solicitor-Advocate of the Higher Criminal Courts and is able to represent clients at the Crown Court and the Court of Appeal. Ian was promoted to Principal Solicitor within the firm in 2014.

Ian deals with all types of criminal work such as theft, assaults, public order offences as well as more serious allegations such as supply of drugs and rape. He has represented people in respect of regulatory offences involving investigations by Natural Resources Wales (previously the Environment Agency) in respect of offences under the Environmental Protection Act.

He also deals with motoring prosecutions such as speeding, careless driving, drink driving and exceptional hardship arguments which can result in clients keeping their driving licences in totting up cases.

Ian enjoys the technicalities of the law and has previously brought Judicial Review proceedings against the Crown Prosecution Service (CPS), as he disagreed with the way that the case was being prosecuted. He argued that the proceedings were unfair and therefore unlawful. Once proceedings were before the High Court the CPS changed the way in which the case was being prosecuted, which corrected the unfairness. He has expertise in benefit fraud investigations and prosecutions by the Department for Work and Pensions and Local Authorities. He is able to provide advice at Interview under Cautions regarding overpayment of benefits (i.e. Housing Benefit, Council Tax Benefit, Income Support, Job Seekers Allowance, Disability Living Allowance (DLA) and any other benefits).

Ian is a qualified Duty Solicitor and a member of the local Court and Police Station Duty Solicitor Scheme. This allows him to provide free and independent legal advice for persons detained at Police Stations and advice, assistance and representation to unrepresented Defendants at Court.
