Collaborative Law


Collaborative Law is a relatively new concept. Its aim is to resolve Matrimonial disputes without recourse to Court. Whilst Divorce proceedings are dealt with via the Court as a paper exercise, participants in Collaborative Law each sign an agreement to deal with financial matters by agreement. A series of meetings between the parties and their legal representatives follows, with a view to reaching an agreement. The agreement is then presented to the Court for approval and embodied into a Consent Order. Should an agreement not be possible, the parties must seek new Lawyers before issuing any Court proceedings. This process is therefore only suitable in cases where both parties are committed to resolving their financial dispute in a non-adversarial way.

To suitable participants, the process can make divorce a much more constructive, and less harrowing process. It can be of particular benefit to those with children, since they must continue to have a working relationship with their former spouse.
